1. Acceptance of Terms

By accessing or using Brandcast (“the Service”) at brandcast.madethis.app, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms constitute a legally binding agreement between you and Brandcast, operated by David Cooke.

2. Description of Service

Brandcast is a subscription-based Software-as-a-Service (SaaS) platform for personal branding. The Service includes, but is not limited to:

  • Voice-to-content generation and transcription
  • Writing style cloning and AI-assisted content creation
  • Automated content calendar and scheduling
  • Viral post prediction scoring
  • Multi-platform social media publishing (LinkedIn, Facebook, Instagram, Threads, TikTok, YouTube Shorts, Bluesky, Medium)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.

3. User Responsibilities

You agree to:

  • Comply with the Terms of Service and community guidelines of each social media platform you connect to and publish on through Brandcast.
  • Not use the Service to create or distribute content that is unlawful, defamatory, harassing, or infringes any third party’s rights.
  • Keep your account credentials secure and notify us immediately of any unauthorised use.
  • Ensure that any voice recordings or other content you upload do not violate any applicable laws or third-party rights.
  • Not attempt to reverse-engineer, scrape, or otherwise misuse the Service or its underlying technology.

4. Subscription and Billing

Access to the Service requires a paid monthly subscription. By subscribing you authorise us to charge your payment method on a recurring monthly basis.

  • Free trial: Where a free trial is offered, it will convert to a paid subscription at the end of the trial period unless you cancel beforehand.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access until that date.
  • Refunds: We do not offer refunds for partial billing periods unless required by applicable law.
  • Price changes: We will give at least 30 days’ notice of any price changes before they take effect.

5. Intellectual Property

Your content: You retain full ownership of all content you create using the Service, including voice recordings, generated posts, and any other materials. By using the Service you grant Brandcast a limited, non-exclusive licence to process and store your content solely to provide and improve the Service.

Our technology: The Brandcast platform, software, trademarks, and all related intellectual property are owned by Brandcast and protected by applicable law. You may not copy, reproduce, or distribute any part of the platform without our express written permission.

6. Limitation of Liability

To the fullest extent permitted by law, Brandcast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose. You are solely responsible for reviewing and approving content before publishing to any platform.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
